These terms govern your use of BitAssure, a service that runs automated checks against websites and mobile applications and reports the results. Please read them before you create an account. By creating an account or using the service, you agree to them.
1. The agreement
This agreement is between you (and, if you are signing up on behalf of a company, that company) and BitAssure. If you are agreeing on behalf of an organisation, you confirm that you have the authority to bind it.
The service means the BitAssure website, the signed-in application, the runners that execute your checks, and the reports and recordings the service produces.
2. Your account
You need an account to use the service. You are responsible for the accuracy of the details you give us, for keeping your password and API keys confidential, and for everything that happens under your account.
- Do not share one account between people who should have separate access. Create separate users instead.
- API keys identify your organisation, not a person. Treat them as secrets and revoke any key you believe has been exposed.
- Tell us promptly at security@bitassure.app if you believe your account has been accessed without your permission.
You must be at least 18 years old, or the age of majority where you live, to hold an account.
3. What you may test
BitAssure drives real browsers and real devices against systems you point it at. That is a capability that can be misused, so this section is the most important one here.
You may only test systems you own, or that you have written permission to test. By starting a run, you confirm that you have that right for the target you have configured.
You must not use the service to:
- test, probe or load any system without the owner's permission;
- attempt to gain unauthorised access to any account, system or data;
- generate traffic intended to degrade or deny service to anyone, including through excessive concurrent runs;
- scrape or harvest personal data belonging to other people;
- circumvent access controls, rate limits, bot detection or licensing restrictions on a third-party service;
- break any applicable law, or infringe anyone's intellectual property rights.
4. Your content and data
Your content stays yours. The projects, checks, screenshots, recordings and reports you create through the service belong to you. We do not claim ownership of them.
You grant us the limited licence we need to actually run the service: to store your content, process it, and display it back to you and to the other members of your organisation. That licence exists only to operate the service and ends when you delete the content or close your account.
Because runs capture screenshots and video of whatever is on screen, they may capture data that appears in your test environment. You are responsible for what your target systems display. We strongly recommend testing against staging data rather than real customer records. How we handle what we do store is described in our Privacy Policy .
5. Fees and billing
Usage is charged in credits, at the rates published on our pricing page . What each kind of run costs is set out there in full. A run is one journey executed against one platform, regardless of how many individual checks it contains.
- Credits are prepaid. They are bought, granted or included before they are spent, and a balance cannot go below zero. You will not receive an invoice for usage you have already had, and you cannot owe us for usage.
- New accounts receive a one-off allocation of credits. It is not replenished.
- Credits you buy do not expire. Credits included with a subscription are allocated for that month and are not carried over.
- Subscription plans are billed in advance and renew automatically until cancelled.
- A run that could not start, or that failed because of a fault in our service, is not charged, any credits taken for it are returned. A run that completes and reports a failure in your application is a successful run and is charged normally.
- When credits run out, new runs stop. Work already produced, reports, recordings, screenshots and run history, remains available to you.
Prices quoted to you include VAT at the rate in force in Botswana, currently 14%. VAT falls due when credits are bought rather than when they are spent, and a tax invoice showing the VAT separately is issued for each purchase. Where a supply is zero-rated or exempt, or where a tax other than Botswana VAT applies to you, the price is adjusted accordingly and the basis is shown on your invoice. We will always tell you before a price change takes effect, and it will never apply to credits you have already bought, nor to a period you have already paid for.
6. Availability
We work to keep the service available and will give notice of planned maintenance where we reasonably can. We do not currently offer a contractual uptime guarantee, and the service is provided on an "as is" and "as available" basis.
BitAssure is a tool that helps you find problems. It does not guarantee that your software is free of defects, and a passing report is not a warranty that your application works correctly. Deciding what to check, and what to do about the results, remains yours.
7. Liability
To the fullest extent permitted by law, neither party is liable for indirect or consequential loss, loss of profit, loss of revenue, or loss of data arising from this agreement.
Our total liability to you in any twelve-month period is limited to the total amount you paid us for the service in that period.
Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud.
8. Ending the agreement
You may stop using the service and close your account at any time. Metered charges already incurred remain payable, and subscription fees already paid are not refunded except where required by law.
We may suspend or end your access if you materially breach these terms, in particular section 3, or if we are required to by law. Except where the breach requires immediate action, we will give you notice and a reasonable chance to put it right.
After an account is closed, we delete its data on the schedule set out in the Privacy Policy . Export anything you want to keep before closing.
9. Changes to these terms
We may update these terms as the service develops. If a change materially affects your rights, we will give you reasonable notice by email or in the application before it takes effect. Continuing to use the service after that means you accept the updated terms.
10. Governing law
These terms are governed by the laws of the Republic of Botswana, and the courts of Botswana have exclusive jurisdiction over any dispute arising from them. Nothing here removes any protection you have under the mandatory consumer law of the country you live in.
